1. How to File a DMCA Notice

Pursuant to Section 512 of the Digital Millennium Copyright Act ("DMCA"), please submit your notice to our designated agent:

To be effective, your notification must include the following:

(a) Your physical or electronic signature; (b) Identification of the copyrighted work or material claimed to have been infringed; (c) Identification of the material that is claimed to be infringing and information sufficient to locate it on the website; (d) Your contact information (name, address, telephone number, and email); (e) A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (f) A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner of the copyright or intellectual property.

Failure to include all of the above information may render your notice invalid.

2. Counter Notification Procedure

If you believe your content was removed in error, you may file a counter-notification. Your counter-notice must include:

(a) Your physical or electronic signature; (b) Identification of the material that has been removed and its location before removal; (c) A statement under penalty of perjury that you believe the material was removed due to a mistake or misidentification; (d) Your name, address, phone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or any judicial district where we may be found if you're outside the U.S.), and that you will accept service of process from the party who submitted the original notice.

3. Additional Information Required for IP Infringement Reports

When reporting suspected IP infringement, include:

  • Name of the IP rights holder

  • Your full name and company name (if applicable)

  • Your mailing address, email, and phone number

  • Detailed description of the allegedly infringing content and where it appears on uneshy.com

  • Declaration that you believe, in good faith, the IP rights have been violated

  • Statement that the information provided is accurate under penalty of perjury
